WILL Releases Statement on New Title IX Changes from Biden Administration

The News: The Wisconsin Institute for Law & Liberty (WILL) released a statement criticizing the new Title IX rules from the Biden Administration as an attack on women across the country.

The Quotes: WILL Education Counsel Cory Brewer stated, “Title IX was meant to protect the rights, safety, and well-being of women and girls in educational activities. But these new regulations turn the intent of the law on its head. Title IX has been in place for over 50 years, and President Biden and his administration are upending its promise of protection and instead pushing an extreme agenda that most of the country disagrees with. Women and girls across our country are being blatantly disrespected, particularly the girls of the Sun Prairie Area School District—who were victims of sexual harassment—by having a fully undressed male shower next to them in the girls’ locker room. These changes are a troubling setback in our nation’s commitment to protect the rights and dignity of all students, especially women and girls.”

WILL’s Previous Work on Title IX: Following WILL’s efforts on behalf of Wisconsin parents, the U.S. Department of Education Office of Civil Rights opened a Title IX investigation into the Sun Prairie Area School District (SPASD). WILL filed a complaint in June of 2023 following a troubling incident that occurred at SPASD, where an 18-year-old male student, who identified as transgender, showered completely undressed next to four freshman girls in the girls’ locker room.  Since the Biden Administration has decided to insert gender identity into the meaning of sex discrimination, we have concerns with how this investigation will conclude.

Effective Date: The final regulations are not effective until August 1, 2024. School boards facing pressure from advocacy organizations and possibly the Office of Civil Rights within the Department of Education should know that these new regulations will face substantial legal challenges. WILL is following this litigation.

No Clarity for Female Athletes: In an attempt to avoid a clear political vulnerability, the Biden Administration has further delayed its Title IX regulation related to boys being allowed to compete in girls’ sports. Legal battles will continue as girls across America are forced to compete with and against boys. WILL is actively following this issue and expect it will eventually reach the United States Supreme Court.
