People have a constitutional right to express themselves and associate with a political candidate by donating to the candidate’s campaign. Restrictions on that ability (such as with campaign contribution limits) implicate fundamental First Amendment rights.
How low is too low for contribution limits? Montana’s limits are exceptionally low – from $180 to $680, depending on what kind of race. Citizens are challenging those limits, and WILL filed an amicus brief on its own behalf urging the United States Supreme Court to hear the case and establish boundaries. Unfortunately, the Court denied the petition.
