Case Name:

WILL REPRESENTS COALITION OF PARENTS, TAXPAYERS, AND SCHOOLS TO PROTECT CHOICE PROGRAM AND TAXPAYERS

Case Type:

Limited Government Project

Case Background

Case Name: Wisconsin PTA v. Wisconsin State Assembly (motion to intervene)

Type of Case: Limited Government Project

Court: Eau Claire County Circuit Court

Case Number:

Filed On: April 14, 2026

Current Status: WILL filed a motion to intervene on April 14, 2026.

WILL represents Wisconsin taxpayers, parents, and choice schools seeking to intervene in Wisconsin PTA v. Wisconsin State Assembly. The complaint in that case asks courts to determine education funding levels and distribution rather than leaving those decisions to the Legislature, and seeks to reduce or eliminate Wisconsin’s School Choice Programs.

The Wisconsin Constitution grants the Legislature authority over education policy and school funding, with the Superintendent of Public Instruction overseeing public instruction, not the judicial branch. The Wisconsin Supreme Court affirmed the constitutionality of Wisconsin’s Choice Programs thirty years ago.

WILL Deputy Counsel Cory Brewer said: “Courts are not legislatures. They do not get to design or run state school finance systems. That is a policy decision for elected representatives.”

The parents and taxpayers represented by WILL believe they will be harmed if the plaintiffs’ demands succeed, because it would fundamentally alter the education system in harmful ways and likely increase state and local taxes without improving educational performance. They contend parents should retain the freedom to choose where their children are educated.

The represented schools include School Choice Wisconsin Action, Impact Christian Schools, Green Bay Area Catholic Education, St. Marcus Lutheran School, Shoreland Lutheran High School, and Catholic Memorial High School.
