Case Name:
WI FAMILIES SEEK FEDERAL INVESTIGATION INTO WESTOSHA LOCKER ROOM INCIDENTS
Case Background
Case Name: Westosha Central High School District Title IX Complaint
Type of Case: Individual Liberties
Court: U.S. Department of Education, Office for Civil Rights, and U.S. Department of Justice
Case Number:
Filed On: March 2025
Current Status: Title IX complaint filed in March 2025.
WILL filed a Title IX complaint with the Department of Education’s Office for Civil Rights and with the U.S. Attorney General against Westosha Central High School for endangering the safety and privacy of multiple female students.
Background
Beginning in December 2024, two female PE students encountered a biologically male transgender student in the girls’ locker room. Female students faced three options: change in front of the male student, use a barely-closing stall, or accept academic penalties. One student received a failing grade for avoiding gym class; another’s family withdrew her from the district.
WILL contends Westosha violated Title IX by failing to respond promptly and effectively to student and parental complaints regarding potential sex discrimination under 34 C.F.R. § 106.44.
WILL Associate Counsel Lauren Greuel said: “When schools force girls into inadequate choices between exposing themselves or facing academic penalties, they abandon common sense. The law requires protections for girls’ equal educational opportunities.”
